What the calculation includes

  • Resale: transfer tax (ITP), generally 7% in Andalucía.
  • New build: 10% VAT plus 1.2% stamp duty (AJD).
  • Notary and land registry, estimated from the regulated fee scales.

How much are buying costs in Spain?

In Andalucía, budget roughly 9–11% on top of the price for a resale home (mainly the 7% transfer tax) and 12–14% for a new build (10% VAT plus 1.2% stamp duty), including notary, land registry and legal fees.

Who pays the notary and land registry when buying a home?

By law and custom in Spain the buyer usually pays the notary and land registry for the purchase deed, unless the contract says otherwise. The seller pays the municipal plusvalía tax.

Is transfer tax calculated on the price I pay?

On the higher of the declared price and the cadastral reference value set by the tax office. If the reference value is higher, the tax is calculated on that figure.

Do non-residents pay more tax when buying?

No. Transfer tax, VAT and stamp duty are the same for residents and non-residents. The difference comes later: non-residents pay non-resident income tax every year on the property.
